1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of andersonfamilyfarms.grazecart.com and 87farms.com(collectively, the “Site”), operated by Anderson Family Farms (“we,” “us,” or “our”).

By accessing or using the Site, placing an order, or enrolling in a subscription, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to use this Site or place an order. By using the Site, you represent that you meet this requirement.

3. Products and Services

We sell farm products directly to consumers, which may include food and agricultural goods.

All product descriptions, pricing, availability, and quantities are subject to change at any time without notice. We reserve the right to limit quantities, refuse orders, or discontinue products at our discretion.

4. Orders and Payments

All prices are listed in U.S. dollars unless stated otherwise.

Payment must be received before orders are fulfilled unless explicitly stated.

Payments are processed through third-party payment processors. We do not store full credit or debit card information.

We reserve the right to cancel or refuse any order for any reason, including suspected fraud or errors in pricing or availability.

5. Subscriptions, Order Changes, and Billing

Subscription Enrollment

By enrolling in a subscription, you authorize recurring charges according to the subscription terms displayed at checkout.

Order Change Deadlines

Each subscription has a clearly stated order modification deadline. Customers are solely responsible for making any changes, pauses, or cancellations before the deadline.

Billing and Missed Pickups

If a customer fails to make changes before the deadline:

The customer will be billed for the full subscription amount

The order will be prepared and allocated

Failure to pick up a subscription order does not cancel the order or qualify for a refund. Perishable products are prepared specifically for the subscriber and cannot be resold.

All subscription charges are final once the modification deadline has passed, regardless of pickup.

6. Pickup, Delivery, and Fulfillment

Pickup locations, delivery options, schedules, and responsibilities are communicated at checkout or directly to the customer.

It is the customer’s responsibility to:

Arrive on time for scheduled pickups

Ensure proper handling and storage of perishable products once received

We are not responsible for product quality or safety once the product has been picked up or delivered.

7. Food Products Disclaimer

Some products sold may be perishable or subject to individual dietary, health, or regulatory considerations.

By purchasing food products from us, you acknowledge that:

You are responsible for determining whether products are appropriate for your consumption

You assume all risks associated with handling, preparation, storage, and consumption

8. Raw Milk and Raw Dairy Products — Assumption of Risk

Legal Acknowledgment

Customers acknowledge that raw (unpasteurized) milk and raw dairy products are regulated and may carry health risks. By purchasing these products, the customer affirms that such purchases are legal in their jurisdiction and permitted for personal use.

Assumption of Risk

By purchasing or consuming raw milk or raw dairy products from Anderson Family Farms, the customer knowingly and voluntarily assumes all risks, including but not limited to:

Illness, injury, or adverse health effects

Risks associated with improper handling, storage, or consumption

Risks inherent to consuming unpasteurized dairy products

No Warranties

Raw milk and raw dairy products are provided “as is”, without warranties of any kind, express or implied, including fitness for a particular purpose.

Customer Responsibility

The customer is solely responsible for:

Determining suitability for themselves and members of their household

Proper refrigeration, handling, and storage

Compliance with all applicable laws and regulations

9. No Medical or Health Advice

Information provided on the Site is for general informational purposes only and is not medical, nutritional, or health advice. Consult a qualified professional for health-related concerns.

10. Returns and Refunds

Due to the nature of farm and food products, all sales are final unless otherwise stated.

Refunds or replacements may be considered at our sole discretion in cases of:

Incorrect orders

Product issues identified at pickup

No refunds are issued for missed pickups or subscription orders not modified before the deadline.

11. User Conduct

You agree not to:

Use the Site for unlawful purposes

Attempt to interfere with Site functionality or security

Submit false or misleading information

Abuse or harass staff or other users

We reserve the right to restrict or terminate access for violations of these Terms.

12. Intellectual Property

All content on the Site, including text, images, logos, and branding, is the property of Anderson Family Farms and may not be used, copied, or reproduced without written permission.

13. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of third-party sites.

14. Limitation of Liability

To the fullest extent permitted by law, Anderson Family Farms shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or products purchased through it.

Our total liability, if any, shall not exceed the amount paid by you for the applicable product or service.

15. Indemnification

You agree to indemnify and hold harmless Anderson Family Farms from any claims, damages, losses, or expenses arising out of your use of the Site, violation of these Terms, or misuse or consumption of products purchased from us.
